S 19; mandatory conditions where licence authorises supply of alcohol
no supply of alcohol may be made under the premises licence
at a time when there is no designated premises supervisor in respect of the premises, or
at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended
every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence

Mandatory conditions

S 21; mandatory condition: door supervision
where a premises licence includes a condition relating to security activity, the licence must include a condition that each individual must be licensed by the Security Industry Authority (there are exemptions re theatre and films and clubs)

Permitted Hours

Alcohol may be sold or supplied from the end of permitted hours on New Year’s Eve to the start of permitted hours on the following day.

Recorded Music

Premises licensed for the sale and supply of alcohol may provide, at any time, regulated entertainment by the reproduction of wireless, including television broadcast and of public entertainment by way of music and singing only which is provided solely by the reproduction of recorded sound.

Variations to Embedded Conditions:

All embedded restrictions inherent in the Licensing Act 1964, the Cinematograph (Safety) Regulations 1955 and the Children and Young Persons Act 1965 removed.

where the film classification body is specified in the licence, unless subsection (3)(b) of S 20 applies, admission of children must be restricted in accordance with any recommendation made by that body

Annex 2 – Conditions consistent with the Operating Schedule

For the prevention of crime and disorder:

1. CCTV will be installed inside and outside the premises, with recording on a hard drive, and maintained in good working order.

2. A minimum of two SIA door supervisors will be employed at the premises from 20:00 until close on New Years Eve and also for all England football matches screened live at the venue. At all other times, the premises licence holder will risk assess the need for door supervisors and employ such door supervisors in such numbers and at such times as deemed necessary by the risk assessment.

3. All door supervisors used will be licensed by the Security Industry Authority (SIA).

4. The premises will become a member of the Business Crime Reduction Partnership and attend regular BCRP meetings as organised by the forum.

For public safety:

5. Ticketing and/or door management will be considered for special events to avoid overcrowding.

6. If crowding of the premises becomes regular, a capacity limit would be agreed with the Fire Officer.

For the prevention of public nuisance:

7. The garden will be enclosed with walls and fencing to reduce transmission of noise.

8. All windows and doors except for access and egress will be closed from 23.30.

9. Signs will be placed at all exit routes from the premises asking customers to leave the premises quietly and respect neighbouring residents.

10. Live music will finish no later than 21.00 outside and 24.00 inside (except New Years Eve).

11. Recorded music volume will be turned down at 23.00.

12. There will be regular monitoring by the DPS and shift supervisors of noise levels outside the premises.

For the protection of children from harm:

13. Anyone seeking to buy or consume alcohol who appears to be under the legal age to do so will be asked to produce photographic evidence as proof of age.

Conditions attached after a hearing by the licensing authority

Annex 3 – Conditions attached after a hearing by the licensing authority:

1. A scheme for soundproofing must be submitted to the licensing authority within 6 weeks of the variation taking effect to address the issue of noise from the existing cooler unit and noise breakout from the windows in the courtyard area.

2. The licensee shall ensure that the placing of refuse – such as bottles – into recycling receptacles takes place at times that will minimise the disturbance to nearby properties and shall not in any event be undertaken before 12.00.

Annex 3a – Conditions attached after a hearing by the licensing authority at variation hearing on 16th October 2012:

1. The outside areas will be closed to the public at 23:00 and all patrons brought inside the main premises, except for the designated smoking areas as follows:-
• Smoking allowed in Area A until closing time – monitored by CCTV
• Smoking allowed in Area B until midnight – monitored by CCTV

2. No drinks to be taken outside, including the smoking areas after 23:00 hours.
