Mandatory conditions

Annex 2 - Conditions consistent with the Operating Schedule

At all times the premises is open the following conditions will apply:

For the Prevention of Crime and Disorder:

1. The outside seating area at the front of Steinbeck & Shaw will be cleared from 22:30 of furniture. This area can remain open as a standing smoking area.

2. No drinks will be allowed in any outside area from 00:00.

Glassware/Plastics

3. Tables will be cleared of empty bottles and glasses on a regular basis.

4. Any glasses into which drink is dispensed will be made from toughened, shatterproof glass.

5. Plastic bottles (where reasonably commercially available - their cost not being more than 15% over the wholesale price of the glass equivalent) will be used on all occasions except that wine, spirit or Champagne can be sold in glass bottles and be provided to customers in any private hire booth, or private seating areas by waiter / waitress service.

6. From 21:00 polycarbonates or shatter proof glass will be used in the outside area.

Door staff

7. All door supervisors will be licensed by the Security Industry Authority (SIA).

8. Records will be maintained at the premises containing the full name, date of birth and home address of every door supervisor.

9. A record will be retained of all dates and times when each door supervisor is on duty. If the door supervisor is employed through an agency, the name of the agency will be included in each relevant entry. The records will be in a form approved by the Licensing Authority.

10. A female door supervisor will be employed and available to search at all times when Pryzm is operating. If for whatever reason there is not one available, due to unforeseen circumstances, then a record of the reason should be made available by the Designated Premises Supervisor and retained on file in the front of house incident log book. If this situation occurs then a male SIA door supervisor can conduct handbag and property searches and if suspicion arises where a further body contact search is deemed necessary and/or appropriate the Police should be called and the incident logged.

Searching/Entry

11. There will be random searching of those people suspected of carrying drugs or offensive weapons. Drugs or weapons taken from customers will be stored securely and delivered to the police in a manner agreed with the police.

12. No customers will be allowed to bring bottles, open or sealed, into the premises.

13. No person will be allowed to take any bottle or glass from the premises.

Radio/BCRP

14. (a) The premises will become a member of the Business Crime Reduction Partnership (BCRP) or similar scheme approved by the Licensing Authority. The scheme must operate, subject to local coverage, radios and additionally an exclusion/banning scheme of named individuals within both the day and night economy.
(b) The DPS or a member of senior management must regularly attend meetings help by the BCRP or similar scheme approved by the Licensing Authority.

15. No person who is restricted access through a Pubwatch/Business Crime Reduction Partnership (BCRP) scheme will be allowed in the premises provided appropriate details have been made available to the premises by the police.

16. Any customer who behaves inappropriately will be barred from the premises and their details passed to any relevant Pubwatch/Business Crime Reduction Partnership (BCRP) scheme.

CCTV

17. (a) Digital CCTV and appropriate recording equipment to be installed in accordance with Home Office Guidelines relating to UK Police requirements for digital CCTV system (PSDB Publication 09/05), operated and maintained throughout the premises internally and externally to cover all public areas, including the entrance to the premises. The system shall be on recording at all times the premises is open to the public.

(b) The CCTV cameras and recording equipment must be of sufficient quality to work in all lighting levels inside the premises at all times.

(c) CCTV footage to be stored for a minimum of 31 days.

(d) The management will give full and immediate cooperation and technical assistance to the Police in the event that the CCTV footage is required for the prevention and detection of suspected or alleged crime.

(e) The CCTV images will record and display dates and times, and these times will be checked regularly to ensure their accuracy.

(f) Subject to Data Protection advice and legislation, the management of the premises will ensure that key staff are fully trained in the operation of the CCTV and will be able to download selected footage onto a disk for the Police without difficulty or delay, and without charge to Sussex Police.

(g) Any breakdown or system failure will be notified to the Police immediately, and remedied as soon as practicable.

(h) The CCTV will record in real time with no time lapse delay.

18. A suitably Security Industry Authority registered and authorised member of staff will be provided to monitor the CCTV from 22:00 when the premises, known as PRYZM, is open for trading.

19. A notice will be displayed at the entrance to the premises stating that CCTV is in operation in the premises.

Further

20. An incident log will be maintained by the premises, providing a detailed note of incidents that occur in the premises. The incident log will be inspected, signed and dated by the Designated Premises Supervisor (or a person with delegated authority), at least once a week, the incident book shall be kept on the premises and be available for inspection by authorised officers of the Licensing Authority and the Police at all times the premises are open. An incident will be defined as one which involves an allegation of a criminal offence. Any refusals made at any of the bars / point of alcohol service, for example, for intoxication or under age, will also be recorded in writing.

21. No person will be admitted to the premises after 03.00 or one hour before closing, whichever is the earlier, although customers may be readmitted at any time providing they are not drunk and their behaviour, dress and demeanour is still appropriate upon readmission.

22. The DPS and/or a senior manager will attend regular quarterly meetings with the police to discuss the running of the establishment and any police suggestions or request for changes to the licence schedule/operating conditions etc.

23. Authorised staff employed by Sussex Police shall have free access to all parts of the licensed premises at all times a licensable activity is taking place, or when the premises are open to members of the public, for the purpose of inspection to ensure compliance with the terms and conditions of the Premises Licence, and to ensure the promotion of the licensing objectives.

For Public Safety:

24. The capacity for the premises will be agreed with the fire officer. An accurate record will be kept of the number of persons admitted to each part of the premises; such records will be kept for 6 months and made available to the responsible authorities.

25. At least one first-aider trained to deal with problems associated with alcohol and drugs will be on duty; if there is more than one on duty, their roles will be clearly defined.

26. Members of the public will not occupy any seat which is closer than 2.5 metres from a ring used in connection with a sporting entertainment.

27. Rooms that are currently known as Curve Room, the Pryzm Main Room, and Disco, as at [16/04/15] shall have their capacity constantly monitored separately by an electronic or manual recording device.

For the Prevention of Public Nuisance:

28. Any noise limiter that is fitted will be used and maintained as set up by a qualified sound engineer.

29. A dispersal policy for the premises will be adopted and a copy will be provided to any of the responsible authorities if requested.

30. Noise or vibration from within the building or from any plant, machinery or equipment will not emanate from the premises so as to cause a nuisance to any residential dwelling.

For the Protection of Children from Harm:

31. At all times the licensee will maintain a comprehensive policy for the protection of children.

32. Persons under the age of 18 will not be permitted on the premises unless accompanied by an adult, unless they are attending an event specially organised for the youth market.

33. In the event that the Scannet system should become inoperable, then Sussex Police will be notified and, where the repair is under the control of the Premises Licence Holder, the system will be repaired as soon as practicable and, in any event, within 72 hours.

34. If the system used for identification scanning should not be working, then the premises will operate a "Challenge 25" Policy whereby any person attempting to buy alcohol appears to be under 25 will be asked for photographic ID to prove their age. The recommended forms of ID that will be accepted will be passports, driving licences with a photograph, photographic Military ID or proof of age cards bearing the PASS mark hologram. The list of approved forms of ID may be amended or revised with the prior written agreement of Sussex Police and the Licensing Authority, without the need to amend the licence or conditions attaching to it.

35. Signage advertising the Challenge 25 Policy will be permanently displayed in prominent locations in the premises, including alcohol point of sales.

36. At specially organised events for the youth market the venue will adhere to its

o Admission policy
o General Policies Statement
o Code of Conduct for Staff Statement; and
o Child Protection Policy.

37. The management will give the police at least 28 days advance notice in writing of all under 18 events. The management accept that the police may request that no such events are held during the two weeks preceding Christmas.

The conditions below will be triggered when only Steinbeck and Shaw is open:

Prevention of Crime and Disorder:

38. There will be a minimum of 1 Personal Licence Holders on duty at the premises from 22:00 until closing, to ensure the responsible sale of alcohol.

39. A minimum of 1 SIA doorstaff will be employed from 22:00, when the premises is open past 01:30.

40. SIA licensed door supervisors shall be employed on any other occasions when a requirement is identified by the licence holder's written risk assessment or requested by Sussex Police in writing at least 48 hours in advance. Further, as part of this written risk assessment the premises licence holder will consult with Sussex Police and take into consideration their advice regarding the following: public holidays, when seasonal variations are taking place and other city wide events e.g. Pride. This written risk assessment will be reviewed every 12 months or sooner should the need arise and a copy shall be retained at the premises.

41. The requirement to scan customers coming into the premises in accordance with the condition 63 will not apply to customers entering the venue via Steinbeck & Shaw on nights when the remainder of the premises, currently identified as PRYZM, is closed. There will however be a requirement to scan all customers entering Steinbeck & Shaw, as well as those using the interconnecting door to enter PRYZM (unless they have already been scanned entering Steinbeck &Shaw) when the premises, currently identified as PRYZM, is open.

42. Notwithstanding Condition 5, drinks may be served in glass drinking vessels, with the exception of major event days in the city centre and additional days, notified in advance to Sussex Police.

The conditions below will be triggered when PRYZM is open and when both PRYZM and Steinbeck and Shaw are open concurrently:

The following three conditions will be observed on any nights specifically aimed at students, during Friday and Saturday nights, public holiday and evenings when other city wide events take place.

Door Staff

43. Subject to conditions 50 and 51 below, the Premises Licence Holder will provide a minimum of 24 door staff, for attendances up to 2,300 from 22:00 on nights specifically aimed at students, on Friday and Saturday nights, public holidays and evenings when other city wide events, for example Brighton Pride, are taking place, and any occasions when requested in writing by Sussex Police no less than 96 hours in advance.

44. The minimum number of door staff may be reduced as follows when the below mentioned entrances and / or club rooms are not open:

Main Entrance not open - reduced by 5
Disco Entrance closed and Disco Room not in operation - reduced by 2
Pryzm Main Room - reduced by 5
Curve - reduced by 4
Disco - reduced by 2

45. On other nights to those listed in condition 49 above, when only one of the club rooms known as Pryzm Main Room, Disco and Curve as at [16.04.15] is open, from 22:00 the Premises Licence Holder will provide door staff at a ratio of 1 to every 75 customers or part thereof in attendance at the premises, with a minimum number of 6 door staff being on duty at all times. On such nights from 22:00 there will be at least 2 door staff on any entrance that is being used.

Condition 52 will be adhered to on any night other than those specified in the three conditions above

46. The conditions 49, 50 and 51 will continue to be observed on any city wide event night such as events for Freshers Week, Brighton Pride, Bank Holidays and New Years Eve. On other nights the Premises Licence Holder will conduct a risk assessment to determine the number of Doorstaff on duty but with a minimum number of 6 with a requirement to reach 24 by midnight when the whole premises is open.

47. The requirement to have the minimum number of door staff in conditions 49, 50 and 51 above can be dispensed with by written agreement with Sussex Police, provided that the Premises Licence Holder requests the appropriate dispensation at least 7 days prior to the day in question.

Body Worn Cameras (BWC)

48. From 22:00 at least one BWC will be used at each entrance by a member of door staff when the relevant entrance is open and being used.

49. From 22:00 there will always be at least one BWC worn by a member of door staff who is circulating within the venue, whenever the venue is open for licensable activities, and there will be an additional BWC worn by a member of door staff when each of the rooms known as Pryzm Main Room, Disco and Curve as at [16/04/15] is open.

So, for example, when only the Pryzm Main Room is open, and the Main Entrance is being used, there will be 3 BWCs deployed: 1 on the Main Entrance, 1 circulating and 1 in the Pryzm Main Room.

When the Pryzm Main Room and Disco is open, and both Main Entrance and Disco Entrance are being used, there will be 5 BWCs deployed: 1 on each entrance, 1 circulating, 1 in the Pryzm Main Room and 1 in Disco.

50. The BWCs will have the ability to record, and any recordings will be kept for a minimum of 28 days and made available to the Responsible Authorities (as defined by the Licensing Act 2003) upon request. Should any camera break or otherwise become inoperable it will be replaced within 48 hours.

Consumption of Bottles within the Booths

51 The Premises Licence Holder shall employ 1 member of staff who will be trained in the BII Award in Responsible Alcohol Retailing to supervise the booths in line with the deployment plan agreed with the Police.

52. Any member of the door team who is circulating the room in which the booths are situated will be designated as having responsibility for monitoring the levels of intoxication in the booths, the dispensing of alcohol in the booths and the removal of any bottles from the booths. Such responsibility to be recorded in the door staff log at the start of the evening.

53. A Duty Manager who shall hold a Personal Licence will have responsibility for monitoring the booths to ensure that customers are not drinking alcohol who are intoxicated, and the bottles are not being removed from the booths; such Duty Manager to hold a Personal Licence and to have no other responsibility during the evening than monitoring the booths, the staff supervising the booths and a record of such role to be noted in the door staff log at the beginning of the evening.

54. Any bottles of spirits provided to customers shall be fitted with a Barsolve Measured Pourer which will measure out a single measure of spirit.

Further

55. There will be a minimum of 2 Personal Licence Holders on duty at the premises from 22:00 until closing, to ensure the responsible sale of alcohol.

56. The premises shall install a minimum of three recognised electronic identification scanning system for customers entering the premises. The system shall be operated at all times door staff are on duty, and all persons entering the premises will be scanned. The system should have the ability to share alerts with other venues using similar ID scanning equipment, identify the hologram as an ID and read both passports and ID cards, including PASS cards. The system should be able to conduct tests to determine if a document is genuine or counterfeit. The system must be compliant with the Information Commissioner's Good Practice Guidance for ID Scanning in Clubs and Bars.

o As an exception to the above condition, any customers who appear to be over the age of 30 can be admitted to the premises without being scanned, provided that the name and date of birth of customers are recorded, and a photographic image of them is obtained. This information will be made available to a Police Licensing Officer or Local Authority Licensing Officer upon request.

o The requirement to scan customers coming into the premises in accordance with above can be dispensed with, with the prior agreement of Sussex Police, provided that the Premises Licence Holder requests the appropriate dispensation at least 7 days prior to the day in question.

57. When the link into the main club is open, all customer wishing to migrate from Steinbeck & Shaw into the main club area will be searched by registered doorstaff.

58. When the link into the main club is open, any customers entering PRYZM from Steinbeck & Shaw will fall in line with the PRYZM glass policy.
