Where a premises licence includes a condition relating to security activity, the licence must include a condition that each individual must be licensed by the Security Industry Authority (there are exemptions re theatre and films and clubs)

Annex 1 - Mandatory conditions

S 19; mandatory conditions where licence authorises supply of alcohol
- no supply of alcohol may be made under the premises licence
(a) at a time when there is no designated premises supervisor in respect of the premises, or
(b) at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended
- every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence

1.—(1) The responsible person shall take all reasonable steps to ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.

(2) In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children–

(a) games or other activities which require or encourage, or are designed to require or encourage, individuals to–
(i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or
(ii) drink as much alcohol as possible (whether within a time limit or otherwise);

(b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic (other than any promotion or discount available to an individual in respect of alcohol for consumption at a table meal, as defined in section 159 of the Act);

(c) provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less;

(d) provision of free or discounted alcohol in relation to the viewing on the premises of a sporting event, where that provision is dependent on–
(i) the outcome of a race, competition or other event or process, or
(ii) the likelihood of anything occurring or not occurring;

(e) selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner.




2. The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).

3. The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.

Mandatory Conditions 4 & 5 come into effect from 1st October 2010:

4.—(1) The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.

(2) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.

5. The responsible person shall ensure that–
(a) where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures–
(i) beer or cider: ½ pint;
(ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and
(iii) still wine in a glass: 125 ml; and
(b) customers are made aware of the availability of these measures.

Variations to Embedded Conditions:
All embedded conditions relating to On Licences Permitted Hours and Children’s Certificate, and conditions attached to the Supper Hours Certificate and Special Hours Certificate have been removed.

4. Late Night Refreshment
The Licence may also provide and permit the consumption of late night refreshment for a period of 30 minutes after the permitted hours set out above, and on New Years Eve until 5am on New Years Day.

5. Recorded Music
Premises licensed for the sale and supply of alcohol may provide, at any time, regulated entertainment by the reproduction of wireless, including television broadcast and of public entertainment by way of music and singing only which is provided solely by the reproduction of recorded sound.

Annex 2 - Conditions consistent with the Operating Schedule:


For the prevention of crime and disorder:

1. To continue to operate in accordance with the standard PEL conditions which are incorporated on the Premises Licence by way of the conversion process.

2. To continue with all existing management controls which already minimise/exclude crime and disorder within the hotel.

3. The premises will operate a policy whereby any person attempting to buy alcohol, or any person attempting to gain entry to the premises, who appears to be under 18 will be asked for photographic ID to prove their age. The only ID that will be accepted is a passport, driving licence with a photograph, or a Portman Group proof of age card bearing the “PASS” mark hologram. The list of aproved forms of ID may be amended or revised with the prior written agreement of Sussex Police and Licensing Authority without the need to amend the actual licence.

4. The management of the hotel will alert police licensing of any function that they believe may potentially result in disorder.

Nightclub Only:

5. SIA registered door supervisors will operate from the premises on Friday and Saturday nights from 21:00 hours until close on a ratio of 1:100 patrons, starting with a minimum of two door supervisors. Door supervisors should also be provided on days and times other than those stipulated above if an internal risk assessment concludes that it is responsible and appropriate to do so for private functions etc.

6. Records will be maintained at the premises containing the full name, date of birth and home address of every door supervisor.

7. A record shall be retained of all dates and times when a door supervisor is on duty. If door staff are employed through an agency the name and address of the agency must be included in the entry referring to the person employed by the agency. Such record to be in a form approved by the Licensing Authority.

8. The licensee will ensure that door supervisors display a name badge and carry proof of licence. [It is a legal requirement that all SIA registered door supervisors display their SIA licence clearly on their person when working].

9. The nightclub premises will sign up to the BCRP Nightsafe (Business Crime Reduction Partnership) radio scheme and the BCRP yellow card scheme. [NB: please note that it is a specific requirement that the premises signs up to the BCRP scheme and not any other scheme not approved by Sussex Police].

10. Pint and half pint glasses where practicable, will be of toughened glass designed not to produce sharp shards when broken. No open glass bottles will be allowed to be taken from the premises.

For public safety:

11. To continue to operate in accordance with the standard PEL conditions and in accordance with all legislation relevant to Public Safety.


For the prevention of public nuisance:

12. In addition to all steps above to ensure that all licensable activities are conducted in a way that neither hotel residents not any other persons in the vicinity of the hotel are adversely affected by the licensable activities.


For the protection of children from harm:

13. To continue to operate in accordance with the requirements of the Licensing Act 2003. In particular in the event of persons who appear to be under 18 attempting to purchase alcohol only Council approved forms of identification will be accepted.




Boxing Events (following Minor Variation, March 2012)

14. Twenty-Eight (28) days written notice will be given by the hotel to Sussex Police Licensing and the Licensing Authority (Brighton and Hove City Council, Licensing Department) for any boxing event.

Conditions attached after a hearing by the licensing authority

NONE

To vary the layout plan showing minor internal changes including relocation of bar servery within existing bar adjacent to reception. The variation will not have an adverse effect on the promotion of any of the licensing objectives as the operation of the premises remains unchanged.
