Annex 1 - Mandatory conditions
S 19; mandatory conditions where licence authorises supply of alcohol
1. No supply of alcohol may be made under the premises licence
a) at a time when there is no designated premises supervisor in respect of the premises, or
b) at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended
2. Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence
3. (1) The responsible person must ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.
(2) In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises-
(a) games or other activities which require or encourage, or are designed to require or encourage, individuals to-
(i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or
(ii) drink as much alcohol as possible (whether within a time limit or otherwise);
(b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic in a manner which carries a significant risk of undermining a licensing objective;
(c) provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less in a manner which carries a significant risk of undermining a licensing objective;
(d) selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner.
(e) dispensing directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).
4. The responsible person must ensure that free potable water is provided on request to customers where it is reasonably available.
5. (1) The premises licence holder or club premises certificate holder must ensure that an age verification policy is adopted in respect of the premises in relation to the sale or supply of alcohol.
(2) The designated premises supervisor in relation to the premises licence must ensure that the supply of alcohol at the premises is carried on in accordance with the age verification policy.
(3) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and either—
(a) a holographic mark, or
(b) an ultraviolet feature.
6. The responsible person must ensure that—
(a) where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures—
(i) beer or cider: ½ pint;
(ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and
(iii) still wine in a glass: 125 ml;
(b) these measures are displayed in a menu, price list or other printed material which is available to customers on the premises; and
(c) where a customer does not in relation to a sale of alcohol specify the quantity of alcohol to be sold, the customer is made aware that these measures are available.
Minimum Drinks Pricing
1. A relevant person shall ensure that no alcohol is sold or supplied for consumption on or off the premises for a price which is less than the permitted price.
2. For the purposes of the condition set out in paragraph 1 —
(a) "duty" is to be construed in accordance with the Alcoholic Liquor Duties Act 1979:
(b) "permitted price" is the price found by applying the formula—
P=D+(DxV)
where—
(i) P is the permitted price,
(ii) D is the amount of duty chargeable in relation to the alcohol as if the duty were charged on the date of the sale or supply of the alcohol, and
(iii) V is the rate of value added tax chargeable in relation to the alcohol as if the value added tax were charged on the date of the sale or supply of the alcohol;
(c) "relevant person" means, in relation to premises in respect of which there is in force a premises licence—
(i) the holder of the premises licence,
(ii) the designated premises supervisor (if any) in respect of such a licence, or
(iii) the personal licence holder who makes or authorises a supply of alcohol under such a licence;
(d) "relevant person" means, in relation to premises in respect of which there is in force a club premises certificate, any member or officer of the club present on the premises in a capacity which enables the member or officer to prevent the supply in question; and
(e) "value added tax" means value added tax charged in accordance with the Value Added Tax Act 1994.
3. Where the permitted price given by Paragraph (b) of paragraph 2 would (apart from this paragraph) not be a whole number of pennies, the price given by that sub-paragraph shall be taken to be the price actually given by that sub-paragraph rounded up to the nearest penny.
4. (1) Sub-paragraph (2) applies where the permitted price given by Paragraph (b) of paragraph 2 on a day ("the first day") would be different from the permitted price on the next day ("the second day") as a result of a change to the rate of duty or value added tax.
(2) The permitted price which would apply on the first day applies to sales or supplies of alcohol which take place before the expiry of the period of 14 days beginning on the second day.

Mandatory conditions

S 21; mandatory condition: door supervision

1. Where a premises licence includes a condition that at specified times one or more individuals must be at the premises to carry out a security activity, each such individual must:

a) Be authorised to carry out that activity by a licence granted under the Private Security Industry Act 2001: or
b) Be entitled to carry out that activity by virtue of section 4 of the Act.

2. But nothing in subsection (1) requires such a condition to be imposed:

a) In respect of premises within paragraph 8 (3)(a) of Schedule 2 to the Private Security Industry act 2001 (c12) (premises with premises licences authorising plays or films): or

b) In respect of premises in relation to:
I. Any occasion mentioned in paragraph 8(3)(b) or (c) of that Schedule (premises being used exclusively by club with club premises certificate, under a temporary event notice authorising plays or films or under a gaming licence) or

II. any occasion within paragraph 8(3)(d) of that Schedule (occasions prescribed by regulations under that Act).

3. For the purposes of this section:

a) "Security activity" means an activity to which paragraph 2(1)(a) of that Schedule applies, and which is licensable conduct for purposes of that Act, (see Section 3(2) of that Act) and

Paragraph 8(5) of that Schedule (interpretation of references to an occasion) applies as it applies in relation to paragraph 8 of that Schedule.

Conditions consistent with the operating schedule

Conditions attached after a hearing by the licensing authority

The Prevention of Crime and Disorder:

1. The DPS or his representative will ensure that all personnel carrying out security shall be licensed by the Security Industry Authority
2. There will at all times be a minimum of two SIA door supervisors at the main entrance to the premises at ground level. There will be a further two SIA door supervisors on each floor whilst that floor is in operation, one working at a fixed point and the other free to supervise the private dances and patrol the floor.
3. Additional door supervisors must be provided on the respective floor on a ratio of 1 to 100 on any occasion when the capacity on that floor exceeds 200 customers. The two door supervisors operating at the entrance will be excluded from this calculation.
4. Records shall be maintained at the premises containing the full name, date of birth and home addresses of every Door Supervisor.
5. On initial employment of the Door Supervisor authentic proof of identity shall be obtained in the form of a passport, drivers licence or a birth certificate. These copy documents will be held at the premises and made available to the Police and/or the Council Licensing Authority immediately upon request.
6. The record shall include all dates and times when a Door Supervisor is employed.
7. If staff are employed through an agency the name and address of the agency must be included in the entry referring to the person employed by the agency.
8. Any such record must be in a form approved by the Licensing Authority. [In the event that no form is either issued or approved by the Licensing Authority, the management may draft their own form but this must contain all the information stipulated in this section].
9. The licensee shall ensure that door supervisors display a name badge and carry proof of licence.

CCTV:
10. Digital CCTV and appropriate recording equipment to be installed operated and maintained throughout the premises internally and externally to a standard specification following consultation with Sussex Police. CCTV footage will be stored for a minimum of 28 days and the management will give full and immediate cooperation and technical assistance to the Police in the event that CCTV footage is required for the prevention and detection of suspected or alleged crime. The Chief Officer of Police or his or her representative of the rank of inspector or above, must be afforded access to video recordings upon request and be provided with a copy, which will be returned to the club within a reasonable time.
11. The premises will ensure that at all times the CCTV system covers both the stairwell leading up to the first floors, the entrance at street level and the area on the street immediately in front of the main entrance are covered by CCTV, and are covered by sufficient lighting levels to ensure clear pictures at all time.
12. The CCTV system will record dates and times.
13. Security arrangements for the dressing rooms in the form of a combination lock with deadlocking latch and a discreet panic alarm within the dressing rooms, linked to the club reception, shall be, maintained at all times whilst the premises are open. No member of the audience shall be admitted to this room under any circumstance and a notice to this effect will be displayed on the door.

Drugs:
14. The management and premises will have an absolute zero tolerance policy towards drugs and drugs misuse. Any illegal drugs seized will be stored in a secure ‘drugs box’ and periodically the management will request the Police to come and remove all drugs in the ‘drugs box’ for destruction.
15. In the event that a person is found on the premises actively dealing in drugs, that person will be detained and the Police will be called to the premises. Any person found with any more than a small quantity of drugs on their possession, which they claim, is for personal use, will still be treated as ‘dealing’ and detained until the Police are called and arrive.
16. The management will permit the Police to use an ‘ION Track’ drugs detector or other similar device inside the premises to detect the illegal use of drugs and will sign the Police consent form.

Public Safety & Protection of Children from Harm:

17. Capacity Limits: The number of persons on the premises shall not exceed 240 inclusive of staff and performers
When the DPS is not on site, there will be a control document held and maintained on site, which will state who is in effective control and management of the premises in the absence of the DPS. Other persons in control and management of the premises in the absence of the DPS will ideally be a personal licence holder, and will be fully competent in all licensing matters, health and safety and emergency evacuation measures.
18. Crime prevention and security measures shall be instigated throughout the premises following consultation with Sussex Police as reasonably required.
19. The management of the premises will meet the Police to discuss the safe and proper management of the premises on a minimum three monthly basis, unless the Police confirm in any one quarter that such a meeting is not necessary
20. The premises will continue to be a member of NIGHT SAFE or any similar organisation set up to replace this. The premises will also sign up to the BCRP Yellow Card Scheme.
21. The premises will report all instances of crime and disorder to the Police.
22. Shatterproof drinking receptacles will be provided where practical.
23. No persons under 18 will be admitted to the premises. The premises will operate a ‘Challenge 25’ scheme, whereby anyone who appears to be aged 25 or younger is asked for photographic ID to prove their age. The only ID that will be accepted are passports, a driving licence with a photograph or Portman Group proof of age cards bearing the ‘PASS’ mark hologram. The above list of acceptable proof of age items may be extended to other forms of ID on the future with advance written agreement of the Police without the need to review the actual licence. The Challenge 25 rule and the stipulated forms of acceptable age identification will be clearly stated both on the premises website and on all membership applications, booking forms, customer contractual documents and promotional literature etc. In addition the licensee will provide a photographic identification system for all entrants to the premises. Recordings to be provided to the police at the request.
24. No under 18’s events will be hosted anywhere on the premises at any time.
25. Whilst striptease entertainment is taking place, no customer under 18 shall be on the premises and clear notices shall be displayed at the entrance to the premises in a prominent position so that it can easily be read by persons entering the premises in the following terms:

26. No intoxicating liquor shall be supplied for consumption off the premises
27. The only form of entertainment which is approved and may be provided at the premises is striptease entertainment in the form of tableside and pole dancing by club dancers only. The premises will not permit one floor to be used for table and/or pole dancing or other forms of entertainment, whilst permitting the other floor to be used for other types of function (whether open to the public or via private booking).
28. The approved striptease entertainment shall be given only be the performers / entertainers and no audience and no audience participation shall be permitted
29. There shall be no inappropriate or deliberate physical contact between the customer and the dancer, with the exception of shaking hands with a customer and/or leading a customer by the hand from a seated area to a booth for a private dance. In addition and with the exception of the above, there shall be no deliberate physical contact between the customer and the dancer, either immediately before the commencement of a dance, during the performance of a dance
30. A customer who is the ‘Stag’ as part of a stag group or a customer attending the premises who is celebrating their birthday or some other genuine special occasion may be taken by the
hand by a dancer to the stage area for the duration of the dance, providing the conduct between the dancer and the customer complies with the prohibition outlined in the previous condition.
31. Dancers shall only perform on the stage area or at a tableside to seated customers. All booths will have adequate lighting to ensure the safety of the dancer and to ensure that both the member / guest / audience and the performer are adhering to the Club rules at all times. A SIA door supervisor will have a full and unrestricted view of any dancer performing in a booth at all times.
32. There shall be no physical contact between dancers whilst performing
33. Dancers may never give out personal information, including telephone numbers, email addresses or other contact details to audience members. Dancers may never accept any telephone number , addresses, business card or any other information from any customer.
34. The private booths will be designed in such a way that there can be no curtain or other visual barrier that can be pulled across the entrance, this concealing activities inside the booth area. The booths will be designed in such a way that the door supervisors / security staff can see into the booths to ensure the safety of the dancers performing inside and to ensure that the club rules are being strictly adhered to at all times.
35. All dancers / performers will be aged over 18 years of age and legally entitled to work in the UK before they perform at the Club. Copies of all dancers files will be made available to the Police Licensing for inspection upon request.
36. Where possible all dancers will be escorted from the premises at the end of each evening to their transport (eg taxis) to ensure their personal safety and security
37. Members and their guests may not at any time take photographs, film, video or mobile phone photographs or footage of performers.
38. Outside of the premises advertising. The Licensee will ensure that there is no display outside the premises of photographs or other images that indicate or suggest that striptease or similar entertainment takes place on the premises.
39. Website. Any promotional website for the premises must comply with
A.S.A regulations and will not display photographs or other images of topless or nude performers, or show photographs or other images that may reasonably be construed as offensive. The website will include a clear requirement stating the challenge 25 proof of age.
40. Promotional literature. Any promotional literature circulated outside of the premises will not display photographs or other images of topless or nude performers, or show photographs or other images or words that may reasonably be construed as offensive. All promotional literature will include clear statements as to the requirements for challenge 25 proof of age.

For the prevention of public nuisance:

41. No more than five people shall queue on the highway outside the premises at any one time
42. No drinks shall be taken beyond the reception area to the outside of the premises
43. The double doors at the bottom of the stairs leading from the main entrance shall be kept closed other than for exits and egress
44. The disposal of waste, including bottles in external refuse bins will be limited between the hours of 0930hrs and 1700hrs
45. The collection of waste including bottles from the external refuse bins will be limited between the hours of 0730hrs and 1900hrs
46. Customers wishing to smoke shall only smoke in the outside allocated area formed by temporary barriers. Only five smokers shall be permitted outside at any one time and monitored and supervised by staff.

To extend the current operating hours for the sale of alcohol, late night refreshment and regulated entertainment (including performance of nude or semi nude dancing commonly referred to as pole or table dancing, making music, entertainment of a similar description, performance of recorded music and other entertainment falling with in the Act) from 1900 hours until 0500 hours on each day of the week and the premises to remain open to the public for a further 30mins to allow "drinking up time" To make technical amendments or remove specific existing conditions as detailed in the application such as to ensure there will be no innapropriate, deliberate, lewd or offensive physical contact between performers and customers. Increase proof of age checks for under 25 year olds To allow the advertising and entry to Stag and Hen Parties.
